Most of our divorce clients want to know how long does a divorce take in Tulsa. Unfortunately, there is no set length of time to finalize a divorce. You will have a general idea of the length depending on the type of case you have. There are three main types: (1) Uncontested, (2) Uncontested with Minor Children, and (3) Contested with or without children.
Types of Divorce in Oklahoma
Uncontested
The fastest and most efficient types of cases are uncontested. Generally, in a case like this the parties are in complete agreement with how to divide assets. Thus, they are ready to sign off on the final divorce decree and move on. In some cases, the divorce may take only 10 days to complete. These types of divorces do not involve any minor children.
Uncontested with Minor Children
Uncontested divorces involving minor or dependent children such as mentally handicapped, may still occur. However, the length will not be a simple 10 days. In Oklahoma, a divorce with minor children of the marriage cannot be finalized until 90 days after its filed. There are certain exceptions to this waiting period such as domestic valance. But, in order to deviate from the time restriction you must get permission from the Judge in your case.
Contested Divorces
As you may suspect, contested divorces mean the parties do not have an agreement on how to divide marital property and/or custody duties. These disagreements often are the result of differing opinions on spousal support, who gets the home, and more. In a contested divorce, you can expect to spend several months gathering paperwork and conducting discovery before you end up in court for a final hearing. In some cases, a contested battle may last for years.
